I have bestowed the most earnest and unwearied consideration to the case now before the Court. The difficulty which it presented was not so much to learn what the law is—what the previous adjudications in like cases have been, as to inquire and be satisfied whether there was any thing in the case favorable to the defendant, which took it out of the general rule of law, or distinguished it materially, from the same class of adjudicated cases.
