CAMERON, Judge.

This is an appeal from a jury verdict in favor of plaintiffs for personal injury suffered by them as a result of a truck accident in the City of Phoenix, Arizona, in 1961.

The facts of the case as they pertain to the appeal are as follows: At approximately nine o’clock in the evening of August the 8th, 1961, the defendant, Edward Arthur Barick, a street maintenance employee for the City of Phoenix, received a call that a tree had blown down in the area of Southern Avenue and 42nd Street in the City of Phoenix, and was obstructing traffic.
