Lincoln County Jail authorities authorized defendant, an inmate, to spend a day working at the Lincoln County Animal Shelter. Some time after arrival at that facility, he walked away. Later apprehended, he was charged with, and convicted of, escape in the second degree (escape from a “correctional facility”) and escape in the third degree (escape from “custody”). On appeal, he argues that neither of those violations occurred; rather, he argues, he failed to return from a “form of temporary release,” a less serious crime.
