This cause comes on to be heard on transfer from the Supreme Court of this state for the assigned reason that the case was wrongfully appealed to said court, and arose from a conviction of plaintiff-in-error (hereinafter called defendant), Roy A. Mitchell of the crime of a second offense of keeping a gaming house. The defendant was indicted in January, 1957 for a misdemeanor of a second offense of keeping a gaming house (1955 Ulinois Revised Statutes, Chapter 38, Section 325).
