There are pending in the Supreme Court in Ulster county proceedings in certiorari to review certain assessments made on the property of the city of New York in the town of Olive, Ulster county. A referee was appointed October 5, 1929, to take evidence concerning the validity of the assessment and to report the same to the court with his findings of fact and conclusions of law with all convenient speed. This referee has become disqualified; and the question involved in this appeal is the appointment of a referee to succeed him.
