OPINION

WILLIAMS, Chief Justice.

This case came before the Court on a petition for certiorari filed by the Rhode Island Insurers’ Insolvency Fund (Insolvency Fund) asking us to review a decree issued by the Appellate Division of the Workers’ Compensation Court (Appellate Division). The Appellate Division decree reversed the trial court’s dismissal of Manuel Thomas’s 1 (employee or Thomas) petition seeking payment of loss of use and disfigurement benefits pursuant to G.L. 1956 § 28-33-19.
