Action by appellees against appellant in the Marion Superior Court sitting as a court of claims. Material averments of the complaint, briefly stated, are, in substance: John D. Williams is the director of the State Highway Commission, and, as such, is authorized to contract on behalf of the State for the construction of state roads; that on January 2, 1924, Williams, for the State, entered into a written contract with appellees for the construction of a certain highway;that the contract, which is made a part of the complaint, provides that, in consideration of $62,423.35, appellees were to…
