Because the Chief Judge dissents from the concepts which follow, they represent only the views of the author Judge.

Upon conviction of taking indecent liberties with a female child of eleven years of age, with intent to gratify his sexual desires, the accused was sentenced to dishonorable discharge, confinement at hard labor for five years, and forfeitures of all pay and allowances for the same period of time. The convening authority affirmed the findings and sentence, but reduced the period of confinement and forfeitures to three years. The board of review…
