The appellant, Sheriff of Dade County, was the respondent below in habeas corpus proceedings and seeks to review a final order of the circuit court which granted the petition for habeas corpus and ordered the discharge of relator-appellee.

The facts of this case are not substantially in dispute. On March 30, 1963, the appellee was arrested without a warrant by a Metro police officer on the advice of one Bullock, a Metro fireman, and charged with the following offenses: (1) careless driving; (2) no driver’s license; and (3) driving while under the influence of intoxicating liquors.
