TJOFLAT, Circuit Judge:
In this criminal prosecution, the district court entered a pretrial discovery order requiring the government to hand over to the defendants all materials obtained by the grand jury during its investigation of defendants, including the testimony of all persons who testified before the grand jury. The government refused to comply with the court’s order; the court imposed sanctions, barring the government’s use at trial of the testimony of any witness who had testified before the grand jury; and the government took this appeal.
