Error to the Court of Civil Appeals, First' District, in an appeal from. Galveston County. The United States Fidelity & Guaranty Co. of Baltimore, Md., brought the suit against Adoue & Lobit. Defendants had judgment. Plaintiff appealed and on affirmance obtained writ of error.

For the purposes of this opinion we adopt the statement of the case *382made by the Court of "Civil Appeals. While quite lengthy it can not be well abbreviated. It is as follows:
“This suit was brought' by the appellant against the appellees, Adoue & Lobit, a banking firm composed of B. Adoue and Joseph Lobit, to recover of said firm, and of the individual members thereof, the sum of $11,939.83, with interest thereon at the rate of six percent per annum from March 7, 1903, together with the court costs paid by appellant in a suit bought in the District Court of Galveston County by S.
