The case settled and signed by the judge of the District Court, under the statute, shows these facts: that an action was brought by the plaintiff to recover of the defendant for services rendered as an attorney in drawing a will, and for other papers and work done, amounting to $85. In making proof of the services rendered and their value, he admitted that he had given a receipt for payment of them to *563‘the defendant, but said that he knew it was of no force, as no part of the claim had been paid.
