PUTNAM, Circuit Judge.

This is a bill brought in the interest of one of the heirs at law of Peter Bent Brigham, late of Boston, in the commonwealth of Massachusetts, deceased, with reference to the construction and effect of the portion of his will which we will hereafter state. The bill was dismissed by the Circuit Court, and the complainant appealed to us. There are several heirs, but the bill was not expressed to be in behalf of all. The respondents are the Peter Bent Brigham Hospital, and the administrators who succeeded in due course the deceased executors of the will, and who were also…
