— Appeal by defendant from a judgment of the Supreme Court, Queens County (Sharpe, J.), rendered July 9,1981, convicting him of criminal possession of a weapon in the third degree, upon a jury verdict, and imposing sentence. 11 Judgment reversed, on the law, and as a matter of discretion in the interest of justice, and new trial ordered. 11 Defendant and his two codefendants were jointly indicted and tried for ro,bbery in the first degree and criminal possession of a weapon in the third degree.
