specially concurring:

I am in full accord with the decision as set forth in the controlling opinion. However, the ruling affirming the commission’s assessment upon appellants of two penalties under the Workmen’s Compensation Act is of sufficient importance to warrant a more detailed discussion.

First. One penalty is under Section 28 of the original Act, Miss. Laws 1948, Chap. 354, which is now Code of 1942, Sec. 6998-34: “ (a) Within ten days after the fatal termination of any injury, the employer shall make a brief report of such occurrence to the commission by telegraph or by…
