The defendant, age eighteen, entered one of the public high schools of the City of New York, at about 9:05 a.m. on January 20, 1955, and proceeded to the fourth floor of the building. A teacher discovered him, and asked him if he were a student, and upon receiving a negative response the teacher took him to the principal’s office. The defendant testified that he was to meet a friend in the fourth-floor lavatory pursuant to an understanding between the defendant and the friend reached the day before.
