ORDER

GILBERT, District Judge.

This matter comes before the Court on the plaintiffs motion to remand. (Doc. 11). The defendant has responded. (Doc. 13). For the reasons discussed below, the Court will grant the motion to remand.

BACKGROUND

The plaintiff, John Alleman, is an attorney. At all times relevant to this action, Donna Newcomb (who is not a party) was an employee at Wal-Mart and had health insurance through the “Associates Health and Welfare Plan,” an ERISA plan (hereinafter “the Plan”).
