SCHWELLENBACH, District Judge.

This action was commenced in the district court of the State of Idaho. The defendant Sears, Roebuck and Co. (hereafter referred to as Sears) removed it to this court. Plaintiff now seeks to have it remanded back to the state court. Plaintiff is a resident of the State of Idaho. Sears is a corporation created under the laws of a state other than Idaho. Defendant Falk Mercantile Company, Ltd., is an Idaho corporation.
