Petitioner in Ms brief has set forth that one Arthur Black brought an action against Mickey Cohen in tort “for an alleged assault and battery asking for pumtive and exemplary damages. ’ ’ At the trial of said action on July 22, 1959, the petitioner, Mickey Cohen, was called as a witness for the plaintiff under section 2055, Code of Civil Procedure.
