In August, 1900, tbe county of Logan commenced an action in tbe district court to foreclose a lien for taxes assessed against tbe property in controversy herein. The owner of tbe legal title and a mortgagee appeared in tbe action and demurred to tbe petition, and, their demurrer being overruled, a decree was entered in favor of tbe *668county February 28, 1901. No appeal was taken from this decree, and in October, 1901, the land was sold to Mary O. Smith, the plaintiff herein, for $250.
