Before the Court is the Motion to Dismiss or in the Alternative,, for Summary Judgment filed by the United States on behalf of the U.S. Forest Service and the Department of Agriculture (Doc. 25).1 All *427responses have been filed, and the matter is ready for disposition. For the following reasons, the motion will be DENIED.
