Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Comptroller denying petitioner’s application for accidental and performance of duty disability retirement benefits.

Petitioner was employed as a police officer for the City of Watertown Police Department. On March 19, 2009, he was struck under the jaw by a suspect he was escorting to the emergency room and his head was suddenly thrust backwards.
