This case is before the court on a Petition for Review of the decision of the Court of Appeals found at 9 Kan. App. 2d 353, 678 P.2d 181 (1984). Clayton Logan (defendant-appellant) appealed the denial of his motion for disqualification of the trial judge due to bias. The basis of his motion for a new trial was two-fold: (1) that defendant’s original attorney was incompetent, and (2) that the trial judge was biased because his son worked as an assistant district attorney for the same judicial district in which the judge presided.
