On July 10,1940, George B. Bobbins, II, filed his complaint in the circuit court as case number 40 C 6371 to vacate and set aside a decree of the superior court which was entered on July 14, 1939. The complaint filed is in the nature of a bill of review wherein it is claimed the decree should be reviewed and set aside because of errors of law on the face of the decree.
