MEMORANDUM OPINION AND ORDER

Plaintiff, Jeanette Luke, brings this action pursuant to Title 42 U.S.C. § 405(g) to obtain judicial review of the final decision of the Secretary of Health and Human Services denying plaintiff’s application for surviving child’s insurance benefits for her son, Scott E. Luke, under Title II of the Social Security Act, 42 U.S.C. § 401 et seq. The plaintiff has moved for summary judgment asking for a reversal of the Secretary’s decision and for an award of benefits.
