PROCEDURAL HISTORY
American Magnesium 1 filed a petition requesting institution of proceedings for an arrangement under Chapter XI of the Bankruptcy Act, 11 U.S.C.A. § 1 et seq. After proper notice was given, a confirmation hearing was held. One creditor, Ozark-Mahoning, objected to the confirmation but was overruled. The bankruptcy judge confirmed American Magnesium’s plan but was then reversed by the Federal District Court for the Northern District of Texas. American Magnesium appeals. We reverse the decision of the district court.
