The executors and trustees under the last will and testament of Francis McCabe, deceased, brought this action to obtain a judicial construction of such will, by which, after providing for payment of debts and funeral expenses, the testator devised and bequeathed all of his estate, both real and personal, to his executors and the survivor of them, to have and to hold the same for and during the life of his daughter' Rosana upon trust to invest and reinvest and keep invested all his personal estate in and upon bonds and mortgages upon real estate in the State of New York and to…
