APPEAL from the Circuit Court for Olm'h County. Action to recover the sum of §110.52, being the balance alleged to be due to the plaintiffs on a contract for cutting, hauling, and banking pine logs. The facts are sufficiently stated in the opinion. There was a verdict for the plaintiffs for $106.66, and from the judgment entered thereon the defendant appeals.

This action is brought to recover the contract price for cutting, hauling, and banking 838,390 feet of pine logs, at $2 per thousand. In the written contract there is a clause requiring the plaintiffs “ to break the roll-ways in the spring.” The plaintiffs gave the defendant credit in their complaint for payments on the contract of $1,566.26. The defendant answered that the plaintiffs cut, hauled, and banked only 191,000 feet of logs, and that they had .been paid therefor the sum of $1,686.66, and that they had failed to break the railways in the spring as required by said contract, to the…
