This matter came before the Court on defendant’s Special Plea in Bar and Motion to Dismiss. The dispute arises out of a motor vehicle accident that occurred on or about May 23, 2005. Plaintiff filed a personal injury complaint on May 3, 2007, praying for compensatoiy damages of $250,000 and punitive damages of $350,000. Plaintiff subsequently took a voluntaiy nonsuit of the case, which was entered by Court Order on March 2, 2009.
