MEMORANDUM AND ORDER
ROTHSTEIN, District Judge.
THIS MATTER comes before the court on the parties’ cross motions for summary judgment. These motions incorporate the arguments made in support of and in opposition to defendants’ earlier motion to dismiss. The history of the litigation is as follows.
On October 13, 1981 plaintiff filed an amended complaint seeking a temporary restraining order and preliminary and permanent injunctions prohibiting defendants from discharging plaintiff from the United States Army on grounds of homosexuality.
