The New Hampshire Bar Association (NHBA) has recommended that the supreme court adopt a new system of rules governing civil procedure, the proposed New Hampshire Rules of Civil Procedure (Proposed Rules). After much consideration, we decline to adopt the recommendation. '

*513Part II, article 73-a of the New Hampshire Constitution provides that “[t]he chief justice of the supreme court . . . shall, with the concurrence of a majority of the supreme court justices, make rules governing... the practice and procedure to be followed” in all courts in the State.
