Tingling, J.), entered September 15, 2009, which granted plaintiffs motion for appointment of a receiver for the purpose of effectuating the sale of the marital residence pursuant to the parties’ separation agreement, unanimously reversed, on the law and on the facts, without costs, and the matter remanded for further proceedings consistent herewith. Appeal from order, same court and Justice, entered March 3, 2010, unanimously dismissed, without costs, as academic.
