MEMORANDUM OPINION
HENRY H. KENNEDY, JR., District Judge.
Plaintiff Bartlett D. Ludlow, a Major in the U.S. Marine Corps, brings this action against Ray Mabus, in his official capacity as Secretary of the Navy, under the Administrative Procedure Act (“APA”), 5 U.S.C. § 706. Ludlow contends that the Board for Correction of Naval Records erred by refusing to remove from Ludlow’s service record an adverse fitness report related to a 2006 helicopter crash.
