Phillip Lakes, the defendant, appellant herein, referred to herein as the defendant, was indicted by the grand jury of Adams County under an indictment containing two counts. The first count charged a violation of the arson statute, Section 2907.02, Revised Code, and charged that the defendant, on January 3, 1962, aided, procured and caused to be burned a certain dwelling house.
