International Refining & Manufacturing Co. d/b/a IRMCO, among others, and GE Betz, Inc., among others, separately seek mandamus relief from the trial court’s denial of a motion for a summary judgment and a motion to dismiss. Although the first named petitioner differs in each petition, the petitioners in both are the same. Therefore, we will hereinafter refer to the petitioners in case no. 1130110 and case no. 1130111 collectively as “the new defendants.” 1 The two petitions were consoli dated for the purpose of writing one opinion.
