Appeal from a judgment of the superior court for Spokane county, Kennan, J., entered February 19,1910, upon sustaining a demurrer to the complaint, dismissing an action for specific performance.

On the 16th day of September, 1908, the parties to this action entered into a contract for the sale of land, the parts of the contract material to our present inquiry being as follows:

“Witnesseth: That the party of the first part hereby sells and conveys to the party of the second part the following described real estate and personal property, to wit: The *315north half (N. %) of section nineteen (19), and the southwest quarter (S.
