On the joint petition of the parties, this cause was advanced.-

Appellant brought a suit in equity to enjoin the state board of school book commissioners, and the individual members thereof, from entering into a contract with D. C. Heath & Co., a book publishing corporation, to furnish certain textbooks for the use of the public schools of the State. A temporary restraining order was issued. Appellees appeared and filed a demurrer to the complaint, which demurrer was sustained.
