This action was brought to recover damages resulting from the death of the plaintiff’s intestate, alleged to have been caused by the defendant’s negligence. The defend ant was engaged in harvesting ice from the Hudson river at Stuyvesant Landing. Its ice house was located upon the banks of the river, and was about 350 feet in length. After ice had formed upon the river in the winter of 1893 the defendant fenced or staked out a field with bushes immediately in front of its ice house.
