This is an action by Gilbert Gray against the Doe Run Lead Company for damages on account of personal injuries alleged to have been sustained by him through the negligence of said company while he was in its employ. A verdict was rendered for plaintiff in the sum of $10,000 and judgment was entered in accordance therewith on the 21st day of January, 1928. On January 25, 1928, defendant filed motion for a new trial and a motion in arrest of judgment, and on February 24, 1928, while these motions were pending, plaintiff, according to the record, by leave of court entered “remittitur of $2500…
