On the 19th day of October, 1895, the above-named defendant was convicted of murder in the first *511degree in the district court of Lewis and Clarke county, and on the 26th day of the same month was sentenced to be hanged. From the judgment and order of court overruling his motion for a new trial, the defendant appeals.
