Plaintiffs brought an action to recover damages for injuries suffered in an automobile accident near Tacoma, on U. S. highway No. 99.

*925Defendant Fields owned the car, and had a policy of insurance which excluded from its coverage accidents occurring while it was driven by another member of the armed forces of the United States,'unless he was in it too.

The defense of the action was tendered to the insurance company, which, after an investigation of the facts, declined it on the ground that the injury was not covered by its policy, because the owner of the car was not in it at the time of the…
