MEMORANDUM OPINION
ALBRITTON, Chief Judge.
I. INTRODUCTION
This cause is before the court on a Motion to Dismiss without prejudice (Doc. # 10) filed by the Plaintiff, Carl S. Berry, on December 15.1999.
The Plaintiff originally filed this action for a Declaratory Judgment in the Circuit Court of Dale County, Aabama. The Plaintiff sought a declaration that the Defendant is required to defend and indemnify him in a separate lawsuit brought against the Plaintiff.
