OPINION

MITCHELL, Judge.

The defendant John D. Withers was indigent and represented at the trial by Assistant Public Defenders Honorable John C. Hough and Honorable Edward G. Draper. On appeal the defendant was represented by the Shelby County Public Defender Honorable Walker Gwinn. The defendant was tried in two separate cases on two separate indictments, one charging rape, and the other charging robbery by the use of a deadly weapon, upon the same person on the same date.
