OPINION

JOHNSON, Judge.

Robert Wolfe, d/b/a/ R & W Drywall (Wolfe) petitions for review of an opinion of the Workers’ Compensation Board (the Board) rendered on January 24, 1997, which affirmed the determination of the Administrative Law Judge (ALJ) that Wolfe had not preserved for review his breach of contract claim against his workers’ compensation insurance earner, the appellee, Fidelity & Casualty Insurance Company of New York (Fidelity & Casualty). Finding no error, we affirm.
