ENGlish, Judge:
On the 27th day of March, 1896, Edward M. Atkinson, instituted an action of trespass on the case, in assumpsit, agaiust William H. Winters and James F. Winters, in the circuit court of Marshall County, to recover three thousand dollars for the use and occupation of a certain farm, with its appurtenances. The declaration contains two counts, ■ — -the first being the ordinary count for use and occupation; and the second, the usual quantum meruit count. The defendants filed three special pleas, — the first being that they did not assume and promise as in the declaration set forth…
