These two appeals will be disposed of in one opinion.

Tbe proceedings were began in tbe Jefferson Coanty Coart in January, 1910, under Section 4260 of tbe Kentucky Statutes, to retrospectively assess property of tbe appellee alleged to have been omitted from taxation. ,Tbey were brought in tbe name of tbe “Commonwealth of Kentucky, by Arthur E.
