— Following a divorce decree entered May 5, 1977, plaintiff, Anne S. Mermon, on August 25, 1977, filed a complaint in equity seeking a partition of certain real and personal property held by herself and James Mermon, her former husband, as tenants by the entireties, *454pursuant to the Act of May 10, 1927, P.L. 884, sec. 1, as amended by the Act of May 17, 1949, P.L. 1394, sec. 1, 68 P.S. §501.
