This cause is here on error and has been heard upon a motion to strike the bill of exceptions and dismiss the proceeding in error upon the following grounds: First, that the bill of exceptions was not prepared and presented to the trial court for allowance within the time required by statute. Second, that the supplemental motion for a new trial on the ground of newly discovered evidence was not filed within the time required by statute.
