Appeal from a judgment of the Supreme Court (Feldstein, J.), entered July 5, 2007 in Franklin County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

In 1999, petitioner pleaded guilty to the crime of robbery in the second degree and received the agreed-upon sentence of five years in prison, to run concurrently with a sentence in New *1405Jersey for a parole violation.
