Bilton v. Lindell Tower Apartments, Inc.

This is a class action in equity, filed March 16, 1945, by plaintiffs, on behalf of themselves and all other bondholders similarly situated, to enjoin and, thereby, prevent final consummation of a proposed ten year extension of $477,100 of outstanding and unpaid "reorganization mortgage registered bonds" issued by defendant Lindell Tower Apartments, Inc., a corporation. The bonds, which were secured by a deed of trust and chattel mortgage indenture (hereinafter referred to as the indenture) on assets of the corporation located in the City of St. Louis, had matured January 31, 1945.
